Terms of Service
Last updated: 1 September 2026
Welcome to Open Class Australia (“Open Class”, “we”, “us” or “our”). Open Class is an online marketplace that connects people who want to book dance classes and series with the choreographers, studios and teachers who offer them. By creating an account, listing a class, or booking a class through Open Class, you agree to these Terms of Service (“Terms”).
Please read them carefully. If you do not agree with these Terms, you should not use the platform.
1. Who may use Open Class
You may use Open Class only if you can form a legally binding contract under Australian law, which generally means you are at least 18 years old. If a class is open to children or teenagers, a parent or legal guardian must make the booking and is responsible for the minor attending.
You must provide accurate account information and keep it up to date.
2. Your account
- You are responsible for keeping your password and account secure.
- You may not share, transfer, or sell your account.
- You can change your display name once every 12 months. Display names must not impersonate another person or business.
- You may delete your account at any time from Settings. Deleting your account does not automatically cancel upcoming bookings; please cancel bookings first.
3. The marketplace and our role
Open Class is a platform that helps dancers find and book classes, and helps creators reach dancers. We are not a party to the contract between you and a creator for the delivery of a class, except where we act as payment collector on behalf of the creator as described below. We do not employ or control creators, and we do not guarantee that any class will proceed as described.
4. Bookings and payments
- Prices shown on Open Class are in Australian dollars (AUD) and are inclusive of GST.
- When you book a class you pay through our payment provider, Stripe. Payment is collected at the time of booking.
- A non-refundable booking fee of 2% of the class price plus $0.30 (both inclusive of GST) is added to each booking.
- For each booking, the class price (after any promo discount) is paid to the creator. Open Class retains the booking fee as its platform fee. For creators using Stripe Connect, this fee structure is applied automatically.
- Promo codes, where valid, apply a discount to the class price only and do not reduce the booking fee.
5. Refunds and cancellations
- You may cancel a booking for a full refund of the class price if you cancel at least 12 hours before the class start time (for a single class) or before the series start date (for a multi-session series).
- The booking fee is non-refundable.
- Within 12 hours of the class start (or after a series has begun), the booking is non-refundable.
- Individual missed sessions within a series are non-refundable.
- Approved refunds are returned to your original payment method and typically take 5–10 business days to appear, depending on your bank.
- If a creator cancels a class, you will receive a full refund of the class price and booking fee.
6. Creators
If you list classes on Open Class, you are a creator. As a creator you agree to:
- Provide accurate, honest descriptions of your classes, venues, dates, times and levels.
- Only list classes you are qualified and permitted to deliver, and hold any required licences, insurances, and venue permissions.
- Comply with all applicable Australian laws, including work health and safety, child-related requirements, and tax obligations.
- Link a Stripe Connect account to receive payouts. Payouts are made by Stripe directly to your connected account.
- Be responsible for the delivery, quality and safety of your classes.
7. Dancers
As a dancer booking classes, you agree to:
- Arrive on time and follow the venue’s rules and the creator’s reasonable instructions.
- Respect other dancers, creators, and venue staff. Harassment, discrimination, or unsafe behaviour is not tolerated.
- Not attend a class if you are unwell or if attending would pose a risk to others.
8. Prohibited conduct
You must not, in connection with Open Class:
- Use the platform for any unlawful, fraudulent, or abusive purpose.
- Attempt to book, pay, or be paid outside Open Class to avoid the platform fee.
- Scrape, copy, or misuse data from the platform.
- Misrepresent yourself, your qualifications, or another person’s classes.
- Interfere with or disrupt the platform or its servers.
We may suspend or terminate accounts and remove listings that breach these Terms, without notice where we consider it necessary to protect others or the platform.
9. Reviews
You may leave reviews of Open Class. Reviews must be honest and based on your genuine experience. We may remove reviews that are false, abusive, or otherwise breach these Terms.
10. Intellectual property
Open Class owns the platform, its branding, and its content. You retain ownership of content you submit (such as class images and descriptions) and grant us a licence to host and display it for the purpose of operating the marketplace. You must only submit content you have the right to use.
11. Disclaimers and liability
Open Class is provided on an “as is” basis. To the extent permitted by Australian law, we are not liable for indirect, incidental, or consequential losses, or for the conduct of creators, dancers, or third parties. Our liability for any claim arising out of or relating to these Terms or your use of Open Class is, to the extent permitted by law, limited to the amount you paid to us (the booking fee) in respect of the booking giving rise to the claim. Nothing in these Terms excludes or limits liability that cannot be excluded under Australian law, including under the Australian Consumer Law.
12. Changes to these Terms
We may update these Terms from time to time. We will indicate the date they were last updated. Continued use of Open Class after changes take effect means you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of New South Wales, Australia. Any dispute is submitted to the non-exclusive jurisdiction of the courts of New South Wales.
14. Contact
If you have questions about these Terms, you can contact us through the Contact us option in Settings.
